<p>General terms and conditions for the use of social-quick-meets.de<br />Status: January 2023</p>
<p>1. validity of the terms of use</p>
<p>1.1 In the relationship between the operator and the member, the following General Terms of Use / GTC apply. Deviating conditions of the user, which are in conflict with these General Terms of Use, shall not apply.</p>
<p>1.2 By registering as a member of social-quick-meets.de, the user agrees to these Terms of Use. Upon registration, the user is given the opportunity to take note of the GTC and must confirm the validity of the GTC.</p>
<p>1.3 Within the framework of the user relationship between the operator and the user, the GTC shall also apply if no further express reference is made to the validity of the GTC when further services of the operator are used.</p>
<p>2 Registration and deregistration</p>
<p>2.1 Prerequisite for registration with social-quick-meets.de as a user is a minimum age of 18 years. In addition, the future member must have the necessary insight and maturity to understand the importance of the collection, processing and storage of personal data. By registering, the User therefore assures the Operator that he/she has reached the age of 18 and that he/she is aware of the significance of the collection, processing and storage of personal data. The operator is entitled to check the personal data, in particular the age of the user by means of suitable official documents.</p>
<p>2.2 social-quick-meets.de offers the services of its platform exclusively for private purposes. Commercial use is not permitted. With the registration the user assures to use the services only for private purposes.</p>
<p>2.3 If the User violates one or more of the aforementioned provisions of sections 2.1 to 2.4, section 8 shall apply.</p>
<p>2.4 The user can unsubscribe at any time without giving reasons in the "Profile" section by clicking on the "Delete profile" button but also by e-mail support@social-quick-meets.de. The user must provide the last name and address used for social networking. To do so, the user must provide the e-mail address last used for social-quick-meets.de. By logging out, the data record stored under the user's profile is completely deleted. The user relationship ends therewith.</p>
<p>3 Description of the social-quick-meets.de offer and protection of minors</p>
<p>3.1 The Operator operates a social network in the form of a communication platform on the Internet. Through which as a registered user for the establishment and maintenance of friendships can contact and communicate with each other. The user has the possibility to register, publish information about himself, create or join groups, invite acquaintances or friends to join his group(s), search for other persons (members/users) within the platform, and much more.</p>
<p>3.2 All information of the individual users (profiles) is stored in a central database of the Operator. Members can view the profiles of other members and contact them.</p>
<p>3.3 However, good manners and etiquette are to be observed at all times.</p>
<p>3.4 As far as users should set further links on social-quick-meets.de on foreign Internet pages, these are pursued by the operator under circumstances and examined for their contents. If the external linked websites contain illegal and/or youth-endangering material of any kind, the respective links will be deleted by the operator.</p>
<p>4. costs</p>
<p>4.1 The registration and all services and other offers of social-quick-meets.de are free of charge.</p>
<p>5 Data use and data protection</p>
<p>5.1 The sensitive and responsible handling of the personal data of all users is a matter of utmost importance to social-quick-meets.de.</p>
<p>5.2 All data protection laws and regulations are strictly adhered to by social-quick-meets.de. These provisions include, above all, the Teleservices Data Protection Act (TDDSG), the Federal Data Protection Act (BDSG), the data protection provisions of the Telecommunications Act and the legislative requirements at EU level.</p>
<p>5.3 social-quick-meets.de does not pass on the personal data of its users to third parties, unless there is a legal obligation to pass on data.</p>
<p>6 Liability of the operator</p>
<p>6.1 The operator is not liable for the content of the publications of the users; this applies in particular to cases in which the content posted by users violates intellectual property (trademark rights, copyright, etc.), the personal rights of third parties or regulations for the protection of minors. This exclusion of liability applies equally to the content of websites linked by users of social-quick-meets.de without the knowledge of the operator. As soon as social-quick-meets.de becomes aware of any violations of the law on the linked third-party sites, such links will be removed immediately.</p>
<p>6.2 The operator is not liable for the accuracy and content of the information provided solely by the users themselves in the registration or profile data of users or for other content generated by users. The operator assumes no liability for the possible misuse of information.</p>
<p>6.3 The operator is not liable for economic, physical or immaterial damage resulting from the use of this networking and communication platform, unless the damage is demonstrably due to intent or gross negligence on the part of the operator or its employees.</p>
<p>6.4 The operator is constantly striving to ensure proper operation of social-quick-meets.de at all times. However, the operator does not guarantee the uninterrupted usability or accessibility of social-quick-meets.de, nor is he liable for technically caused transmission delays or failures. For example, technical malfunctions or necessary maintenance work may lead to a temporary interruption of the service of social-quick-meets.de.</p>
<p>6.5 The operator is not liable for the unauthorized access of personal user data by third parties to the database. The operator is also not liable for the misuse of data and information that the users themselves have made available to third parties.</p>
<p>6.6 The operator will regularly - but will not enter into any such obligation - check the content of any text and submitted photos or graphic files for compliance with the law, in particular the provisions on the protection of minors and, if necessary, delete them in whole or in part.</p>

<p>In particular, it is not allowed to use or link (Trafficklau) the images/photos/files on own/other/foreign pages/internet pages/domain online or offline.</p>

<p>7.1 The user is solely responsible for the content of his registration and thus for the information he provides about himself. He assures not to violate any laws or rights of third parties through his behavior and content uploaded by him (texts, images, etc.), in particular to respect the general personal rights and intellectual property rights of third parties. The user undertakes to create at least one real profile with complete information.</p>
<p>In case of non-compliance, we reserve the right to delete the information in the profile and to block the user.</p>
<p>The members are also prohibited from any actions that damage the reputation of social-quick-meets.de - even if these actions take place outside our homepage!</p>
<p>7.2 The disclosure and exchange of passwords, codes and serial numbers of any kind are not allowed on the platform.</p>
<p>7.3 Furthermore, no profiles may be set up on social-quick-meets.de or Internet pages that serve to improperly read out, store, edit, change, forward or otherwise misuse information.</p>
<p>7.4 The user assures that his use of social-quick-meets.de is exclusively for private and not for business purposes and that he will not use the platform of social-quick-meets.de and the data of third parties entrusted to him for the purpose of commercial advertising. It is not allowed to misuse profiles as advertising. Operators of private homepages that do not require membership are excluded under reserve. Finally, the user assures never to distribute illegal content in any form on social-quick-meets.de.</p>
<p>7.5 The user may use the service of social-quick-meets.de only for the intended purpose of the private exchange of information and the establishment of mutually desired private contacts. Any form of mass mails etc. is prohibited. Any solicitation of members to other social networks is prohibited.</p>
<p>7.6 In order to comply with the statutory provisions, in particular the secrecy of correspondence and telecommunications, the user must treat e-mails and other messages confidentially and may therefore only make them accessible to third parties with the express prior consent of the sender. This also applies to names, photos, telephone and fax numbers, address data, e-mail addresses and/or URLs (Internet addresses). Any breach of confidentiality, in particular any misuse of such data by manual or automated reading, storage, processing, modification, deletion, etc. will be prosecuted to the extent possible.</p>
<p>7.7 In addition, the user may not intercept e-mails or other messages for other users and may not attempt to do so. The user may send e-mails and similar messages to members exclusively for the purpose of private communication, not to advertise or offer goods or services to other members. In particular, the user may not send or organize chain letters, pyramid schemes, contests, lotteries, betting games snowball systems or multi-level marketing.</p>
<p>7.8 Under no circumstances may the user violate applicable laws when using the service of social-quick-meets.de or use the service in a way that negatively affects the availability of the offers for other users of social-quick-meets.de.</p>
<p>Without prejudice to the possible criminal liability of the user, content is in particular inadmissible if it:</p>
<p>- describe cruel and otherwise inhuman acts of violence against human beings in a manner that glorifies or trivializes such acts of violence or that portrays the cruel or inhuman nature of the act in a manner that violates human dignity; this also applies to virtual depictions<br />- serve as an instruction to an illegal act mentioned in ? 126 para. 1 of the Criminal Code<br />- are sexist or pornographic and/or involve violence, the sexual abuse of children or adolescents or sexual acts of humans with animals; this also applies to virtual depictions.</p>
<p>7.9 Furthermore, the dissemination of defamatory, offensive or otherwise unlawful material, harassment or threats and the violation of the personal rights of other users or other third parties is abusive.<br />- No insults or untrue facts about third parties<br />- No pictures with strangers, without the consent of the same<br />- No violation of third party privacy rights<br />- No content relevant to criminal law (e.g. racist statements, pornographic content, etc.)<br />Furthermore, the dissemination of content in legal gray areas, with ambiguities and offensive content is to be refrained from.<br />In particular<br />- The dissemination of sexual preferences<br />- Profiles that contain sexual preferences</p>
<p>8. legal consequences in case of violation of these terms and conditions</p>
<p>8.1 In all cases of violation by one or more Users of one or more provisions of these Terms of Use, in particular of one or more provisions of clauses 2.1 to 2.4 and/or clause 7, the Operator reserves the right to exclude the User from the Service with immediate effect, without giving reasons and excluding the User's right to claim damages, and to completely delete the User's Account, including all its data. In such cases, the right to initiate civil and/or criminal proceedings, in particular the assertion of claims for damages and/or the filing of criminal charges, is expressly reserved.</p>
<p>8.2 Contractual penalty provision: If a User violates one or more provisions of sections 2.1 to 2.4 and/or section 7, the User, insofar as he is of legal age, is obligated to pay a contractual penalty to be determined by the Operator at its reasonable discretion and, in the event of a dispute, to be reviewed by the competent court, to the Operator upon first request. Furthermore, if the User is of legal age, the User is obligated in such a case, immediately upon request by the Operator, to submit a cease-and-desist declaration, which is subject to a contractual penalty and which is customary according to legal standards.</p>
<p>8.3 If the User is of legal age, the User agrees to indemnify and hold the Operator harmless from any claims, damages, losses or demands that may arise from any misuse of the Service by the User and the violation of these GTC. As far as the User is of legal age, he/she undertakes in particular to indemnify the Operator from any liability and from all obligations, expenses and claims resulting from damages due to insult, slander, defamation, violation of personal rights, due to the failure to provide services to other Users, due to the violation of intellectual property rights (trademarks, copyrights, etc.) or other rights. The indemnification obligation shall also extend to the costs of the necessary legal defense (attorney's fees) required to defend against such claims.</p>
<p>8.4 Sections 8.2 and 8.3 shall also apply to users who are not yet of age, but who have the necessary capacity of understanding and culpability.</p>
<p>9 Electronic attacks by hackers, crawlers, etc.</p>
<p>9.1 Electronic attacks of any kind on the platform social-quick-meets.de or on individual users are strictly prohibited. Any electronic attack will result in the immediate exclusion of the user and will be prosecuted, as far as possible, under civil and criminal law.</p>
<p>9.2 Electronic attacks are considered in particular, without this list being exhaustive:</p>
<p>- Hacking attempts, i.e. attempts to overcome, circumvent or otherwise disable the security barriers of social-quick-meets.de<br />- use of computer programs to automatically read data such as crawlers (a.k.a. spiders or robots, in short: bot)<br />- the intentional use and/or distribution of viruses, worms, Trojans<br />- use of links, programs or other procedures that can or are intended to damage the platform social-quick-meets.de or individual users<br />- mass spamming</p>
<p>10. privacy policy for the use of LiNet apps that we offer on our pages.</p>
<p>LiNet can recognize which sub-page it is on each sub-page of this community and can read out and evaluate the contents of the page. Thus, e.g. profiles can be recognized in order to output corresponding content via the apps.<br />The evaluation of this content only takes place within the technically necessary framework. No private content will be stored on LiNet servers without your consent.</p>
<p>The following data is stored on LiNet servers:<br />- your user ID (which you have in this community)<br />- your username<br />- your gender<br />- your age<br />- link address to your profile picture (the picture itself is not stored on LiNet servers!)<br />- your number of points (points system of this community)<br />- your selected language<br />- date & time of your last activity</p>
<p>This data may be evaluated and used for the LiNet apps.<br />None of the collected data will be passed on or sold!</p>
<p>11. preservation clause (severability clause)</p>
<p>If any provision of the General Terms of Use is or becomes invalid or incomplete in part, the validity of the remaining clauses of the General Terms of Use shall not be affected. The invalid provision shall be replaced by a provision that comes as close as possible in economic terms to the meaning and purpose of the invalid provision in a legally effective manner. The same applies to any loopholes in the General Terms of Use.<br />12 Place of jurisdiction and applicable law</p>
<p>The law of the Federal Republic of Germany shall apply.</p>

<p>LiNet can recognize which sub-page it is on each sub-page of this community and can read out and evaluate the contents of the page. Thus, e.g. profiles can be recognized in order to output corresponding content via the apps.<br />The evaluation of this content only takes place within the technically necessary framework. No private content will be stored on LiNet servers without your consent.</p>
<p>The following data is stored on LiNet servers:<br />- your user ID (which you have in this community)<br />- your username<br />- your gender<br />- your age<br />- link address to your profile picture (the picture itself is not stored on LiNet servers!)<br />- your number of points (points system of this community)<br />- your selected language<br />- date & time of your last activity</p>
<p>This data may be evaluated and used for the LiNet apps.<br />None of the collected data will be passed on or sold!</p>
<p>11. preservation clause (severability clause)</p>
<p>If any provision of the General Terms of Use is or becomes invalid or incomplete in part, the validity of the remaining clauses of the General Terms of Use shall not be affected. The invalid provision shall be replaced by a provision that comes as close as possible in economic terms to the meaning and purpose of the invalid provision in a legally effective manner. The same applies to any loopholes in the General Terms of Use.<br />12 Place of jurisdiction and applicable law</p>
